Is electric bicycle a motor vehicle
Electric bicycles do not belong to motor vehicles. Non motor vehicles refer to vehicles driven by human or animal power on the road, as well as motorized wheelchairs, electric bicycles and other transportation vehicles for the disabled that are driven by power devices but have the highest design speed, empty vehicle mass and overall dimensions in line with relevant national standards. The electric bicycle refers to an electromechanical personal transportation tool that uses the battery as the auxiliary energy and is equipped with motor, controller, battery, handle brake and other control components and display instrument system on the basis of ordinary bicycles. The most important part of an electric bicycle is its motor. The motor of an electric bicycle basically determines its performance and grade. Article 58 of the Road Traffic Safety Law of the People’s Republic of China, when disabled motorized wheelchairs and electric bicycles run in non motor vehicle lanes, the maximum speed shall not exceed 15 kilometers per hour. Article 119 For the purposes of this Law, the following terms mean: (1) “roads” refer to highways, urban roads and places that are under the jurisdiction of units but allow the passage of public motor vehicles, including squares, public parking lots and other places for public passage; (2) “Vehicles” refer to motor vehicles and non motor vehicles; (3) “Motor vehicle” refers to a wheeled vehicle driven or towed by a power unit and running on the road for people to ride or for transporting goods and carrying out special engineering operations; (4) “Non motor vehicles” refer to vehicles driven by human or animal power and running on roads, as well as motorized wheelchairs for the disabled, electric bicycles and other vehicles driven by power devices but with maximum design speed, empty vehicle mass and overall dimensions in line with relevant national standards; (5) “Traffic accident” refers to an event in which a vehicle causes personal injury or death or property loss due to fault or accident on the road.
