Is electric bicycle a motor vehicle
An electric bicycle with a running speed of less than or equal to 20KM is a non motor vehicle, and a traffic accident that exceeds the standard needs to be identified. According to the identification results, it can be identified as a motor vehicle. According to the relevant provisions of the Road Traffic Safety Law of China, “non motor vehicles” refer to vehicles driven by human or animal power on the road, as well as motorized wheelchairs, electric bicycles and other vehicles for the disabled, which are driven by power devices but have the highest design speed, empty vehicle mass and overall dimensions in line with relevant national standards. Therefore, determining whether an electric vehicle belongs to a motor vehicle or a non motor vehicle mainly depends on the driving mode, maximum speed and vehicle weight. In terms of driving mode, there are two kinds of electric vehicles on the market at present. One is pedal electric vehicle, which does not support pedaling, and obviously belongs to motor vehicle. The other is electric bicycle, which supports pedaling. The standards of electric bicycle include (new national standard): 1. It must be equipped with pedal function; 2. The maximum speed shall not exceed 25km/h; 3. Motor power shall not exceed 400w; 4. The battery voltage shall not exceed 48v; 5. The vehicle mass shall not exceed 55KG; 6. Under the condition of normal and reasonable use of foreseeable misuse and failure, the electric bicycle shall ensure that there is no danger (such as electric shock, explosion, combustion, etc.).
